1. Introduction

Work Plus Health ("we", "us", "our") is an occupational health services provider operating across Western Australia and nationally. This Privacy Policy explains how we collect, use, disclose and protect personal and health information about individuals who use our services, including workers referred for assessment, enquiry contacts and website visitors. We are committed to handling your information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

2. The kinds of information we collect

We collect information necessary to provide occupational health services. This may include: identification and contact details (name, date of birth, address, phone, email, employer and role); medical history and clinical information relevant to fitness-for-work assessments; the results of medical examinations, tests, screenings and health surveillance (including audiometry, spirometry, drug and alcohol testing and skin checks); injury management and return-to-work information; and billing and claims-related information. We also collect limited technical data when you visit our website, such as IP address, browser type and pages visited, via cookies and analytics tools.

3. How we collect information

We collect information directly from you when you complete an enquiry, attend an appointment, provide a medical history or complete testing. We also collect information from third parties with your authority or as required by law, including from referring employers, treating practitioners, insurers and contracted pathology or specialist providers. Where an employer refers you for a pre-employment medical, injury management or health surveillance service, they provide us with your contact and role details so we can deliver the assessment.

4. How we use and disclose your information

We use personal and health information to: provide and manage the occupational health services requested; conduct assessments, testing and health surveillance; prepare fitness-for-work and clinical reports; manage injury management and return-to-work plans; communicate with referring employers, treating clinicians and insurers about your care (only where relevant and authorised); meet our legal, regulatory and professional obligations; and operate, secure and improve our services. We do not sell personal or health information to third parties.

5. Sensitive and health information

Health information is "sensitive information" under the Privacy Act and is given a higher level of protection. We will only collect health information with your consent, where it is required to provide a service you have requested, or where collection is authorised or required by law. Health information is only used or disclosed for the purpose for which it was collected, or for a directly related purpose that you would reasonably expect, unless an exception applies (such as where disclosure is required by law or to lessen or prevent a serious threat to life, health or safety).

6. Sharing with employers

When an employer refers you for a pre-employment assessment or injury management service, we provide the employer with a fitness-for-work or return-to-work report. These reports focus on whether you are fit for the role and any recommended workplace adjustments. We only share clinical detail with an employer where it is necessary and relevant to fitness for work and safe work, and otherwise limit disclosure to outcome-level information. Where the service is provided through a workers' compensation claim, information may be shared with the insurer and treating practitioners as required to manage the claim.

7. Data security and retention

We take reasonable steps to protect personal and health information from misuse, interference, loss, and unauthorised access, modification or disclosure, using secure storage, access controls and encryption where appropriate. We retain records for the period required by law, professional standards and our retention policy (typically at least seven years for health and workers' compensation records, or longer where required), and securely destroy or de-identify records when they are no longer required.

8. Accessing and correcting your information

You have the right to request access to the personal and health information we hold about you, and to ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. To request access or correction, contact us using the details below. We will respond within a reasonable period and may charge a reasonable fee where a substantial request is made. In limited circumstances we may refuse access (for example, where giving access would pose a serious threat to life or health, or would unlawfully interfere with another person's privacy).

9. Marketing and communications

We may use your contact details to send you service-related communications, appointment reminders and, where you have opted in, occasional updates and occupational health insights. You can opt out of marketing communications at any time by using the unsubscribe link in any email or by contacting us. We will not use or disclose your information for direct marketing where you have asked us not to.

10. Third parties and overseas disclosure

We may engage trusted service providers (such as IT, booking, pathology and reporting platforms) to help deliver our services, under agreements that require them to protect information in line with the Privacy Act. We generally store information within Australia, but if we need to disclose information overseas we will do so in accordance with the APPs and take reasonable steps to ensure it is handled securely. We will tell you if we disclose your information overseas where it is practicable to do so.

11. Your right to complain

If you believe we have breached your privacy or mishandled your information, please contact us using the details below. We will investigate and respond to your concern. If you are not satisfied with our response, you may complain to the Office of the Australian Information Commissioner (OAIC) at www.oaic.gov.au or on 1300 363 992.
